Terms of Service
These terms govern your use of the ArkFlo website and the free Bottleneck Diagnostic. Read them — by using the site, you agree to them.
These Terms of Service ("Terms") are a binding agreement between you and ArkFlo ("ArkFlo," "we," "us," or "our"), operated by ArkFlo LLC, a Florida limited liability company. They cover your use of arkflo.io, the Bottleneck Diagnostic, and related pages, forms, and communications (the "Site"). If you don't agree, don't use the Site.
1. What ArkFlo provides here
The Site offers information about ArkFlo's services and a free Bottleneck Diagnostic that produces an informational scorecard and suggested next steps based on the answers you provide. The Diagnostic and everything on this Site is informational only. Any paid engagement — such as an Operator Install — is governed by a separate written agreement, not these Terms.
2. No guarantee of results
The Diagnostic, scorecards, case studies, examples, and any results, revenue, time-savings, or outcomes described on this Site are illustrative, not promises. Results depend on your business, your market, your effort, and many factors outside our control. Individual results vary, and the experiences described are not a guarantee that you or anyone else will achieve the same or similar results.
Nothing on the Site is legal, financial, tax, accounting, or other professional advice. You are responsible for your own business decisions. Where we describe a typical or expected outcome, we base it on our experience at the time; it is still not a guarantee.
3. Eligibility and your account information
You must be at least 18 and able to form a binding contract. When you submit information through the Site (for example, in the Diagnostic), you agree it is accurate and that you have the right to share it.
4. Acceptable use
You agree not to: use the Site unlawfully; interfere with or disrupt the Site or its security; attempt to access areas or data you're not authorized to; scrape, harvest, or copy the Site or its content except as allowed by law; or use the Site to send spam or harmful code.
5. Intellectual property
The Site and its content — text, design, graphics, logos, the ArkFlo name and marks, methodology, and the Diagnostic itself — are owned by ArkFlo or our licensors and are protected by law. We grant you a limited, personal, non-transferable license to use the Site for its intended purpose. You keep ownership of the information you submit, and you grant us the rights described in our Privacy Policy to use it to provide the Services.
6. Third-party services and links
The Site uses and links to third-party services (for example, our scheduling and CRM tools and analytics providers). We're not responsible for third-party services, their content, or their terms. Your use of them is at your own risk and subject to their terms.
7. Disclaimer of warranties
The Site and the Diagnostic are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any result or recommendation will be accurate or suitable for your situation.
8. Limitation of liability
To the fullest extent permitted by law, ArkFlo and its members, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenue, data, or goodwill, arising from or related to your use of the Site or the Diagnostic. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless ArkFlo and its members, officers, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your breach of these Terms.
10. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction — except that either party may seek injunctive relief in any court of competent jurisdiction. You agree to first contact us at hello@arkflo.io to try to resolve any dispute informally.
11. Privacy
Your use of the Site is also governed by our Privacy Policy and, if you opt in to text messages, our SMS Terms & Conditions.
12. Changes
We may update these Terms. When we do, we'll change the "Last updated" date above and post the new version here. Your continued use of the Site means you accept the updated Terms.
